Nebraska PTO Payout Law

✓ Verified against official sources · September 1, 2026 Neb. Rev. Stat. §§ 48-1229(6), 48-1230
The short answer: Nebraska law expressly includes earned but unused vacation in the wages due at separation — regardless of policy language — while other paid leave is payable only if agreed.
Payout at separation
Required — earned, unused vacation is wages by statute
Use-it-or-lose-it
Cannot forfeit earned vacation at separation
What's payable
Earned, unused vacation; other paid leave only if agreed
Penalty for non-compliance: Unpaid vacation is recoverable as unpaid wages under the Nebraska Wage Payment and Collection Act, with attorney's fees available in court.

Nebraska wrote the answer into its definitions. Under Neb. Rev. Stat. § 48-1229(6), wages include fringe benefits — and while most paid leave is excluded from the wages due at separation "other than earned but unused vacation leave," that carve-out makes earned, unused vacation expressly payable when employment ends, unless a different agreement was made with the employee or a collective-bargaining representative for other leave types.

The payout rides Nebraska's final-pay deadline in § 48-1230: the next regular payday or within two weeks of the termination, whichever comes first. Unpaid amounts are pursued under the Wage Payment and Collection Act, with attorney's fees for prevailing employees in court.

For employersNebraska's statute singles out vacation: earned, unused vacation leave is wages at separation no matter what the handbook says — but sick leave and other paid leave follow the agreement.
For employeesYour earned, unused vacation must be in your final check — due on the next payday or within two weeks, whichever comes first — even if a policy claims otherwise.

Nebraska FAQ

Can a Nebraska policy make vacation expire at termination?
No — the statute includes earned but unused vacation in the wages due at separation, so a policy cannot forfeit it. Accrual design (rates, caps) remains the employer's choice.
Does Nebraska require sick leave payout?
No. Paid leave other than earned vacation is excluded from separation wages unless the employer agreed to pay it out.
