Colorado PTO Payout Law

✓ Verified against official sources · September 1, 2026 C.R.S. §§ 8-4-101(14), 8-4-109
The short answer: Colorado requires payout of all earned, unused vacation at separation — policies cannot forfeit vacation that has already been earned, per the CDLE and Nieto v. Clark's Market.
Payout at separation
Required — earned vacation cannot be forfeited
Use-it-or-lose-it
Void as to earned vacation — accrual caps are allowed
What's payable
Earned vacation pay under the policy or agreement
Penalty for non-compliance: Unpaid vacation is unpaid wages: after a written demand goes unanswered 14 days, the employer owes the greater of 200% of the amount or $1,000 — 300% or $3,000 if willful (C.R.S. § 8-4-109(3)).

Colorado settled this question at its supreme court: in Nieto v. Clark's Market (2021), the court held that under the Colorado Wage Act, earned vacation cannot be forfeited — and the CDLE's INFO #3E guidance implements exactly that. An employer may control how vacation is earned (accrual rates, caps, eligibility), but once earned, it is wages payable at separation.

Because unpaid vacation is unpaid wages, Colorado's demand machinery applies: a written demand unanswered for 14 days triggers a penalty of the greater of 200% of the wages or $1,000, rising to 300% or $3,000 for willful failures (C.R.S. § 8-4-109(3)).

For employersSince Nieto v. Clark's Market (2021), any policy language purporting to forfeit earned vacation at separation is unenforceable — audit old handbooks, because the policy text doesn't save you.
For employeesWhatever vacation you earned under the policy must be in your final pay. If it isn't, send a written demand — after 14 days the amount can double or triple.

Colorado FAQ

Can a Colorado employer use a use-it-or-lose-it vacation policy?
Not against vacation that's already earned — forfeiture clauses are unenforceable per Nieto and CDLE INFO #3E. Caps on how much can accrue going forward remain lawful.
Does Colorado's rule cover sick leave too?
The payout rule covers earned vacation pay. Separate sick leave banks under the state's paid-sick-leave law don't have to be cashed out — but a combined PTO bank is generally treated as vacation.
