AVOIDING WORKPLACE RETALIATION LAWSUITS
Most managers and supervisors have heard constant warnings about discriminating on the basis of race, sex, age, disability, and all the other characteristics protected by law. But there's another type of activity, often overlooked, that is forbidden by those same anti-discrimination acts and a host of other laws and regulations. That "hidden" aspect of discrimination is retaliation. In many cases, monetary awards from retaliation claims have been won even when the original discrimination claim was rejected.
According to the EEOC, retaliation claims are the fastest growing type of claim filed. And in Burlington Northern Santa Fe v. Shelia White, the U.S. Supreme Court has made it even easier for employees to win retaliation claims — adding even more impetus to the growth rate.
Once an employee has filed a charge of discrimination, or participated in a discrimination proceeding, or otherwise opposed discrimination, he/she may not be fired, demoted, harassed, or otherwise retaliated against for that initial action. So you can see what a quagmire supervisors face in ensuring that all their management decisions are completely legitimate and legal when a complaining employee is the target of the decision.
