Background

 

The new Family and Medical Leave Act (FMLA) regulations released in November of 2008 required employers to make many changes to their FMLA policies, procedures, and documentation. They also provided the much anticipated interpretation and regulatory framework for the family military  leave amendments of January 2008.

 

These new regulations have not lessened the confusion for employers, especially in areas such as determining what is a qualifying serious health condition; complying with notification and certification requirements; and providing intermittent leave.

 

A DOL survey indicated that over 35% of employers complained that it was difficult to administer the Family and Medical Leave Act. And it is!
