Background
The new chief of U.S. Immigration & Customs Enforcement (ICE), John Morton, recently announced that the agency is going to increase the number of companies it will audit for I-9 violations and regularly impose fines on violators.
Chief Morton also noted that ICE has already dramatically increased the number of Form I-9 audit notices issued. He pointed out that in July, 652 notices were issued. He said that many more employers will soon be notified that their I-9 records will be audited.
3 Strikes And You're Out — Lots of Cash!!
I-9 violations can be devastating. Fines for I-9 violations range from $110 to $1,100 for one single, minor, or technical violation. Incorrect I-9 forms can be used as evidence of knowingly hiring an illegal alien that can result in a fine of up to $3,200 per violation. A third offense can lead to a fine of up to $16,000 per offense.
Employers need to take compliance seriously because there are multiple errors that an auditor could uncover that would result in a fine. For example, if the auditor discovers that 200 of your forms had a minor mistake, that would result in a minimum fine of $22,000 — not a bad for a day’s work for an ICE auditor.

Federal Contractors Beware
On September 8, the federal government began to require federal contractors and sub-contractors to use E-Verify for both new hires and current employees who are assigned to work on the contract.
