3. What should an employer do if it finds itself in the possession of documents that disclose genetic information about an applicant or employee?
Treat those documents in accordance with the Americans with Disabilities Act's confidentiality provisions. In other words, employers must maintain genetic information on separate forms and in separate medical files, treat the information as a confidential medical record, and limit internal access to the information to those with a legitimate need to know.
