Background
On August 24, 2009, the Department of Health and Human Services (HHS) issued the final regulations related to the Health Information Technology for Economic and Clinical Health Act (HITECH) passed earlier this year.
The new regulations require covered entities under the Health Insurance Portability and Accountability Act (HIPAA) and their business associates to provide notification to individuals and the HHS of breaches of unsecured protected health information by unauthorized individuals.
The regulations require that all individuals that have access to protected health information (PHI), as defined under HIPAA, be trained on how to handle incidents of involuntary disclosure of PHI.
These new data breach notification rules become effective in late September of 2009 (only 30 days after their official release).
